Fiscal Sponsor Agreement

BakkMe
Effective date: May 9, 2026 • Last updated: May 9, 2026

This Agreement applies whenever you, as the Organizer, create a fundraiser on BakkMe whose Beneficiary is another individual, an informal group, or any entity for which you are not the legal payee. By checking the Fiscal Sponsor acknowledgment in the create-fundraiser flow, you agree to act as a fiscal sponsor on the terms below.

1 Role of the Organizer

As Organizer, you publicly raise funds on behalf of a Beneficiary. BakkMe routes donations to a payout destination linked to your verified profile (or a charity profile you administer). You hold those donor funds in trust for the Beneficiary until they have completed their own identity verification (KYC) and the funds are forwarded to them.

2 No Commingling of Funds

Donor contributions raised on behalf of a Beneficiary are not your personal funds. You agree that you will not commingle them with your own assets, will not use them for any purpose other than forwarding to the Beneficiary, and will not treat them as personal income.

3 Forwarding Funds to the Beneficiary

You agree to forward the net donation amount to the Beneficiary within a reasonable time after the Beneficiary's KYC has been approved by BakkMe's verification provider, less any platform or payment processor fees disclosed to donors at the time of contribution.

4 Tax Treatment

Funds received in your fiscal-sponsor capacity are generally not taxable income to you, since you hold them in trust and forward them to the Beneficiary. However, tax treatment depends on your jurisdiction and personal circumstances. BakkMe does not provide tax advice. You are responsible for consulting a qualified tax professional in your country and for accurately reporting any amounts you do retain (for example, fees you elect to keep as the Organizer).

5 Donor Communications

You agree not to misrepresent the use of donor funds. Any updates you post on the fundraiser must accurately describe how funds are being held, when they are forwarded, and any change in circumstances that affects the Beneficiary's ability to receive them.

6 Sanctions, Fraud and Prohibited Use

You confirm that the Beneficiary is not a sanctioned person or located in a sanctioned jurisdiction, and that the fundraiser does not finance any activity prohibited by applicable law or BakkMe's Terms of Service or Acceptable Use Policy. BakkMe may pause or terminate any fundraiser, freeze funds, or require additional verification at any time if it has reasonable suspicion of misuse.

7 Liability

You acknowledge that BakkMe acts as a technology platform connecting Organizers, Beneficiaries, and donors, and is not itself the recipient or distributor of donor funds. To the extent permitted by law, BakkMe disclaims liability for disputes between Organizers and Beneficiaries regarding the use or distribution of fiscally sponsored funds. You agree to indemnify and hold BakkMe harmless from claims by donors or Beneficiaries arising from your conduct as Organizer.

8 Updates to this Agreement

BakkMe may update this Agreement from time to time. The "Last updated" date above reflects the most recent change. Material changes will be communicated through the app or by email. Continued use of fiscal-sponsor functionality after a material change constitutes acceptance of the updated terms.
